How To Get Spouse Visa
In order to get a visa for your spouse, the first thing you have to do is to file a Petition for Alien Relative, Form I-31. The appeal must be made to the Department of Homeland Security, U.S Citizenship and Immigrations Services in your area. It is important to note that only legal marriage qualifies your better half as your spouse, living together will not suffice and for polygamy, only the first spouse can get an immigration visa. If the country you come from gives a common-law spouse, the same rights as in legal marriage, only then can the common-law partner be granted permission for immigration.
Apart from the Petition for Alien Relative, the Affidavit of Support, Form I-864 is another form that is required for the immigrant visa for spouses. You must be above 18 years of age and have a residence in the United States in order to fulfill the criteria for submission of this form. There are two ways of letting your partners come into the U.S to live with you: 1. You can get the formalities of the visa process done by your spouse in another country by sponsoring his/her immigrant visa. After the procedure of obtaining the visa is completed, your better half can come into the States and receive permanent residential grant at the earliest with the IR1 or CR1 visa that he/she gets. All you have to do is submit the Petition for Immigrant Relative (Form I-130). After this, USCIS, the National Visa Center and the US Embassy will fulfill all the required formalities and grant your partner the immigrant IR1 or CR1 visa. 2. You can also get the K-3 visa. This non-immigrant visa can be attained within three months. The request must be made to the US Embassy in your spouse's country. The procedure will be started there and your partner will have to come to the U.S where it will be completed. However, you have to submit the Petition for Alien Fiance (Form I-129 F) for your partner. K-3 is a recently added visa category and thus the form is called so, rather than Petition for Alien Spouse. Once this has been done, your spouse can come to the United States. One of those two ways should work. Either way stick with it and don't get discouraged.
