Canadian Immigration For Spouse
The Citizen and Immigration Canada is the authority for granting immigration visa to foreigners. The visas are granted irrespective of caste, race national or ethnic origin. The CIC aims at causing economic growth, providing shelter to refugees and bring members of family together. There are three types of permanent visas granted: Family Class, Economy Class and Refugee Class. Quebec is an exception because its government has a unique immigration system.
For obtaining a visa under the working class, the candidate is evaluated by a point system. If the results prove that, the person will be able to sustain himself in Canada. Having prior experience in any job is an edge and the CIC gives precedence to candidates having a government job offer in Canada. Business executives can also apply for visas according to the Business Immigration Plan. This category is further narrowed down to Investors, Self-Employed and Entrepreneurs. Legally married partners alone qualify as spouse. Homosexual partners or common-law spouses do not suffice. The partners are individually assessed according to Schedule 1 even if they are going to be united with their partners in Canada or are accompanying an individual candidate who is the partner. In case of an exception, where the separation of a same sex or common-law partner can result in suffering, the immigration authorities can admit them on grounds of humanitarianism. The immigration authorities, however, must be convinced about the authenticity of the marriage. It is clearly said in Section 4(3) of Immigration Regulations: "The family class does not include a spouse who entered into the marriage primarily for the purpose of gaining admission to Canada as a member of the family class and not with the intention of residing permanently with the other spouse." It is imperative to furnish evidences of a genuine relationship, like photographs, videos, letters etc. The immigration authorities refuse to permit a residential visa if they have inkling that the relationship is just an instrument for getting into Canada. |
